Delivery charges and GTCT

 

We deliver free of costs for deliveries inside Germany (minimal order value 250€). For deliveries under 250€ order value shipping costs are the following:

We also deliver to the following countries:
Austria, Switzerland (plus customs duty), Belelux (Belgium, Holland, Luxembourg), France, Spain and Italy. For deliveries to these countries, please ask us about the shipping costs. Just order as usual, we will individually find out about the most economic costs for delivery.

 We ship half pallets and pallets by forwarding agency (Lebert) and packages by DPD. For special deliveries like express or delivery by 10 am, please contact us. Please provide a valid address and a phone number for a flawless delivery.

 

 

General terms and conditions of trade


1. General

The following GTCT are valid for all contracts, deliveries and other services. Any divergent agreements, including in particular conflicting terms and conditions of business of the customer are not agreed upon by us. Supplementary agreements require our officially signed acknowledgement. Our company is authorised to change or complement these GTCT with an appropriate cancellation period at any time. Purchase orders arriving before that will be handled by the then valid GTCT. The following terms and conditions are recognised by the customer when placing an order. They are valid for all agreements,  offerings and deliveries.

2. Offering

Our offerings are all non-binding. Small aberrations and technical changes to our pictures or descriptions are possible. Dimensions stated are only approximative.

3. Delivery and payment

Term of payment is promptly without discount. All prices stated are inclusive of the valid VAT at the day of delivery. Once we have informed you about the delivery costs and thus given you the final price, the contract is in effect by your agreement. Minimum order quantity is 30 Euro. New customers can only pay by advance cash bank transfer or collect on delivery.

Whenever a deficiency (defect) occurs, the contractor has the right to choose a compensation delivery, reduction of the bill or conversion. When a compensation delivery is not done and the contractor does not decide for reduction of the bill or conversion, or when the compensation delivery has a deficiency as well, the customer can claim conversion or reduction of the bill.

Shipping is done by parcel service or forwarding agent. Delivery time depends on distance and availability. Shipping is done without insurance. Plants can not be insured (by ADSp). Special delivery forms asked for by our customers are charged with the usual surcharge. Shipping is on account of the customer (other conditions can be agreed upon).

4. Right to return

Purchaser who are consumers in the sence of the consumer protection law, may resign from a contract realised by long-distance-transaction within 14 days after delivery of the ordered products. It is sufficient when the declaration of resign is given within these 14 days without any stated causes. In the case of a resign, a reimbursement (partly or fully) is only made concurrent to performance, meaning the returning of the delivered goods. It is requirment, that the returned goods are unused and in a condition that makes it possible to  sell them again. Whenever goods are returned that have signs of usage, are damaged or the boxing is damaged, we charge an appropriate compensation for the loss of value. The same appies whenever complement parts are missing on returned goods.

This right to return does not apply for purchases made directly in our retail shop.

5. Passing of risk

Whenever the customer is not end-consumer, the risk passes on to him/her, as soon as the goods are shipped off by our company.

6. Warranty

At the time of passing of risk, our company guarantees that the bought goods are free of material defects and manufacturing faults and has the contractually assured features. We do not give a warranty for plants to take roots, because we have no influence on care and planting.

At the arrivel of our delivery, the customer has to unpack the goods (plants) and check them for defects and quality. In case the customer is not end-consumer, any open or hidden defects are to be announced to us in writing within 14 days. On any reclamation or claim the date of purchase has to be proven with a invoice. The complained product has to  be returned to us together with a copy of the invoice and sufficiently stamped.

This warranty does not apply for normal deterioration or wearout. The warranty expires when the customer alters the delivered goods. During the time of warranty, our company has the right to rework free of charges. A full or partial replacement of the product is permitted. Whenever defects are not remedied in an adequate time, the customer has the right for conversion or reduction of the bill. Article 476a of the German Civil Code (BGB) does apply.

7. Reservation of proprietary rights

The goods delivered remain our property until they have been paid for in full. Reservation of proprietary rights do not lose validity when a customer implants the delivered plants temporarily on his or external premises until reselling them. In the case of a resell, the customer already conveys the following claim for the resell in the amount of our claim for the not paid delivery price to us, without a seperate declaration of assignment being required. The reservation of proprietary rights remains in spite of a resell. Force majeure disengages us from our bondage to the sales agreement, the customer cannot claim compensation in such a case.

8. Storage of data

Data of the customer needed for business purposes are stored and processed in our computer system, following article 33 of the German Federal Data Protection Act (BDSG). Personal data is handled confidentially and is not handed over or sold to a third party.


9. Place of jurisdiction

Place of fulfilment and place of jurisdiction for both parties is our companies place of business (business headquarters). The laws of the Federal Republic of Germany apply exclusively.

10. Amendment

Scheduled prices (prices listed) are not valid in our retail store. On request, additional conditions of sale can be given later.
